Lee Honors College Facility Usage Agreement
Parties
This Usage Agreement is entered into between the Board of Trustees of Â鶹´«Ã½ (WMU) with an address of 1903 W Michigan Ave, Kalamazoo, MI 49008 and the SPONSOR identified below.

You must submit a copy of your completed and signed Event Authorization form to Jennifer Townsend prior to your event. In the event that this has not been submitted, the reservation will be canceled.
Payment of fees
Sponsor shall pay the total usage fee (check payable to Â鶹´«Ã½ and given to the Building Coordinator) at least one week prior to the usage date.
Adherence to Policies and Regulations
Sponsor agrees to abide by Lee Honors College regulations regarding the use of the facilities which are summarized below and in full detail attached hereto, and to abide by all applicable policies procedures, and regulations of WMU including but not limited to its policies on alcohol use and consumption, the ban on smoking anywhere on the WMU campus, and the anti-discrimination policy, as well as applicable laws, regulations, and ordinances. This Agreement shall be interpreted under the laws of the State of Michigan.
Indemnification and Insurance
To the maximum extent allowed by law, Sponsor agrees to indemnify and hold harmless WMU, its board, officers, directors, and employees from any and all claims, judgments, debts, suits, liabilities, damages, and demands resulting or arising from Sponsor's use of the facilities. If required, no later than 15 days prior to the start of the usage period, Sponsor must submit a certificate of liability insurance in the amount of $1,000,000 for the duration of the usage period naming WMU as an additional insured. The Dean of the Lee Honors College or his designee must approve any exception to the amount of coverage. It is further agreed that the Sponsor will pay for any loss or damage to the Lee Honors College or its equipment that occurs as a result of this usage.
Lee Honors College Facility Usage Limitations
The Lee Honors College reserves the right to determine the physical appropriateness of events held in honors college facilities. This determination can be the basis for usage approval or (if complications arise) could become cause for its cancellation. The Lee Honors College does not have staffing available to provide theatrical production in its spaces. Furthermore, no props, set pieces, or scenery may be used if they require being fastened to the floor or walls or being hung from above, and no materials may be used which would damage any surface and/or finish. We reserve the right to prohibit any "surprise" activity even at the last minute. Should any of the facility's equipment need to be augmented or substituted by the Sponsor, said Sponsor will be responsible for provision of such equipment as well as cost of installation. WMU reserves the right of approval of any and all equipment provided by the Sponsor. We reserve the right to prohibit any inappropriate activity even at the last minute. Facilities must be returned to the condition in which they were found prior to Sponsor's departure.
Food and Beverage
Food and beverages are allowed provided the menu has been cleared and approved by the Building Coordinator. Alcoholic beverages may not be used, distributed, or permitted without the express written consent of WMU via Timothy Kellogg, the University's appointed legal affairs representative.
Admission Fees
There is usually no objection to charging an admission fee for an event or for taking donations, but such intentions must be declared in advance and the Lee Honors College reserves the right to deny such permission. The Sponsor is then responsible for all aspects of collection. The intended procedure must have Lee Honors College approval.
Mandatory Program Notice
To meet directives of the state fire marshal, the following notice is required in printed programs: "Building emergencies will be indicated by spoken announcement within the seating area. In any emergency, walk - do not run - to the nearest exit."
Contract Agreement
This agreement constitutes the complete understanding of both parties regarding this usage. It is understood that any changes, additions, or deletions must be in written form signed by both parties as an addendum to this agreement. It is further understood that this agreement cannot be assigned or transferred. The undersigned also affirm that they are authorized representatives of the involved parties.
